Tortious Interference with a Business Relationship

Florida recognizes an independent tort of intentional and unjustifiable interference with business relationships or with a contract.

Tortious interference with a contract and tortuous interference with a business relationship are basically the same cause of action where the only material difference is that in a contract action there is a contract and in the business interference case there is a business relationship.

In both types of cases the conduct by the wrongdoer must be intentional.

The injured victim must establish the following elements:

  1. existence of a business relationship;
  2. knowledge of the relationship on the part of the wrongdoer;
  3. intentional and unjustified interference with the relationship by the wrongdoer;
  4. damage to the victim as a result of the breach.
